DIVORCE – Can one spouse kick the other out of the house?

In the breakdown of any marriage or defacto relationship, the law gives to each of the spouses the right to apply for a Court Order that will force the other spouse to exit and remain away from the family home. There are two ways that this can be done:

  • An “Ouster Order” which is made under the Qld Domestic Violence and Family Protection Act; or
  • An Exclusive Occupancy Injunction which is made under s.114 of the Family Law Act

For many years now, the Ouster Order option has been the preferred solution. There are no filing fees , easy to complete forms, an expedient and simplified hearing process in front of a local Magistrates Court, and perhaps, most importantly of all, the availability of the local Police who can assist (in varying degrees) with the obtaining, service and enforcing of the Order.

Potential detractions with Ouster Orders however, is that to be entitled to one, the applicant spouse must be prepared to hit the other spouse with a full Domestic Violence Order (DVO) which of course also requires that spouse to prove that there has been “violence” within the household. DVO’s of course are entirely necessary and appropriate where violence is in play, but there are many other situations where non-violent behaviours can make things so uncomfortable in the home, that continued sharing of the home is rapidly becoming intolerable and – it’s only a matter of time before someone cracks.

In these more border-line situations, an Exclusive Occupancy Injunction (EOI) might be a better solution. In a recent decision of the Family Court, the Court said that whilst it would not normally grant an EOI on the mere existence of tension in the home, it was similarly not necessary to prove that a shared home life had become intolerable and that instead, the Court only needed to be satisfied that it was not reasonable or sensible to expect the parties to continue to share a home together.

In that case, the availability of another residence where the Wife could live (rent free) was a sufficient tipping point for the Court to grant an EOI in favour of the Husband against the Wife, even though there was no evidence to say that there was any prospect of violence between them.

Federal Government

12th March 2020 – $17.6B

  • Low income Australians on Centrelink payments are eligible for a $750 payment from 31st March 2020 in the hope that much of this money will go directly back into the economy.

Employer Cashflow Subsidies to help keep employees on the payroll.

  • 50% of any wages tax withheld, refunded up to $25,000, and a minimum payment of $2,000 even if no PAYG is withheld from employees.
  • $150,000 instant asset write off (tax deduction) for business equipment purchases before 30th June 2020.
  • 50% wage subsidies for around 117,000 Australian apprentices and trainees, up to maximum of $21,000.

20th March 2020 – $66B

  • Accelerated income support for employees and sole traders that have lost their job or had a 20%+ downturn in sales.
  • Newstart payment has been renamed to JobSeeker payment, with extra $550 coronavirus supplement payment on top of the Jobseeker payment.
  • Temporary Early Release for Superannuation of $10,000, and a further $10,000 from 1st July 2020, to eligible government payment recipients.

Employer Subsidies

  • Employer Subsidies increase from $2,000 to $10,000 as a minimum and $25,000 to $50,000 as a maximum and a further 100%, spread between June & September 2020 BAS returns.
  • Business Loans up to $250,000, managed by your bank, underwritten 50% by the federal government for a 3 year term with reduced interest and 6 months deferred repayments.

Qld Government

  • low interest loans up to $250,000 or 50% of PAYG tax withholding for 2019 financial year, for a 10 year term, with no interest or repayments in the first year.

30th March 2020 – $130B

  • Fortnightly $1500 JobKeeper Payment for businesses where revenue has dropped 30% or more.
  • Rental Tenant Protection introduced.

How to determine a fall in turnover

You only need to satisfy this requirement once – you do not need to retest turnover each month.

At the time you enrol in the JobKeeper payment scheme, you need to confirm that your business in a relevant period has had, or is likely to have, a:

30% fall in turnover (for an aggregated turnover of $1 billion or less)
50% fall in turnover (for an aggregated turnover of more than $1 billion), or
15% fall in turnover (for ACNC-registered charities other than universities and schools).
How to calculate a fall in turnover for the first fortnight starting 30 March 2020

To work out your fall in turnover, you can compare either:

GST turnover for March 2020 with GST turnover for March 2019
projected GST turnover for April 2020 with GST turnover for April 2019
projected GST turnover for the quarter starting April 2020 with GST turnover for the quarter starting April 2019.

Federal Government To Cover Cost Of Childcare

All parents with children currently in child care will be eligible for free care, including students and the unemployed if your child/children were enrolled with a provider prior to March 2nd 2020.

The Federal Government bailout will cost an estimated $1.6 billion to assist the struggling industry and provide some relief to families, many of whom have taken their kids out of care.

Under the plan, the Federal Government will pay half of the operating costs of Australia’s 13,000 childcare and early learning centres.

Federal Education Minister, Dan Tehan said, “If parents have an existing relationship with a childcare centre, they will get free childcare. We want as many people able to work as we possibly can and we want them to be able to access childcare as they need to make sure their children are being looked after while they are working and helping us deal with the Coronavirus pandemic.”

“We want to ensure your childcare centre will remain open so that where you normally take your child to get cared for, that will be there for you so you are not looking to have to go to a new centre.”

Newspapers Fold or Suspend Print

A century of tradition fades as newspapers across the country halt printing or close their doors altogether due to a steep and sudden Coronavirus related downturn.

As we sit at home and consume more local news than ever, some newsrooms are being forced to close as advertising revenue dries up.

Many papers rely heavily on the real estate industry, with their large pull-out sections as well as pubs, clubs and hotels for regular weekly revenue.

With the current real estate open home and auction restrictions and widespread hospitality business closures, that bulk revenue stream has dried up and the traditional publishing industry, which was already struggling has been pushed to the brink.

Newsrooms are empty across the nation at a time when people are relying on having the news at their fingertips.

Several regional communities have been left shocked at the closure of their only print news publication. The Sunraysia Daily, Mildura’s only daily newspaper, which should be celebrating their centenary this year has announced its’ closure, along with the Swan Hill Guardian, the Gannawarra Times and the Loddon Times in the Mallee region of Victoria.

After 122 yrs in operation, Broken Hills’ only daily newspaper ‘Barrier Daily Truth’ has had to suspend operations due to a collapse in revenue. Thirty staff at the newspaper are now out of work.

Gippslands Yarram Standard, which is 145 years old and Great Southern Star, which was celebrating its 130th year in print have both suspended operations.

Newscorp has announced that it will suspend the print of 60 publications across the country from 9th April, including our Quest Community Newspapers which includes our local Pine Rivers Press, The Caboolture Herald and The Redcliffe Herald.

Other Newscorp publications to be suspended include those published by News Local in NSW, Leader in Victoria and Messenger in South Australia. All will continue to publish digitally during this time.

News Corp’s decision was not taken lightly. According to the company’s Australasia executive chairman Michael Miller, “The suspension of our community print editions has been forced on us by the rapid decline in advertising revenues following the restrictions placed on real estate auctions and home inspections and the forced closure of event venues and dine-in restaurants in the wake of the coronavirus emergency.”

Assist The Elderly and Vulnerable – North Lakes Region

Call-out to those who need assistance and those who would like to assist in the North Lakes region.

We have a separate assistance call-out for the Redcliffe Peninsula here.

We are calling upon local charities and community organisations in particular to co-ordinate assistance to the best of their capability in whatever form that may be, including home delivery to the many in our community who are elderly, immunocompromised, living with chronic illness, locals in self-isolation who still need to access to essentials to get by.

Unfortunately, many of these people are not on social media but still, a large enough number are that here we can reach out.

We are all very touched by images of our aged locals and pensioners doing their best to access essential groceries, personal care and medication they need just to get by, but we need to activate as a community to protect the vulnerable from this illness.

Woolworths are providing exclusive access to grocery aisles between the hours of 7am and 8am for those with a government-issued seniors, pensioner or disability card.

Many vulnerable locals are self-reliant and proudly so, however, a once in a century pandemic changes everything and we now call upon local charities, community organisations to raise their hand.

The situation we face is a short term one. Herd immunity and immunisation will eventually render this disease to the history books. In the meantime, the immediate challenge is to minimise the number infectious and vulnerable persons circulating in the community.

If you are a charity or organisation willing to assist those in need at this time, please comment below with your page. Individuals willing to help and vulnerable persons may also wish to comment to illicit direct replies.

University Sunshine Coast (USC) Moreton Bay Campus Official Opening

Today the University Sunshine Coast (USC) Moreton Bay was officially opened with dignitaries from across the local political landscape in attendance.

The University was officially opened by Federal Education Minister Dan Tehan, and Peter Dutton, Federal Member for Dickson and Minister for Home Affairs.

More than 400 invited guests attended this historic occasion at the entrance to the impressive, three-storey building that has 16,000 square metres of floor space, state-of-the-art technology, and already accommodates more than 1,200 students.

Among the speakers today were Federal Education Minister Dan Tehan, Queensland Attorney-General and Minister for Justice Yvette D’Ath, Federal Member for Dickson and Minister for Home Affairs Peter Dutton, Acting Moreton Bay Mayor Mike Charlton, USC Chancellor Sir Angus Houston AK, and USC Vice-Chancellor Professor Greg Hill.

Queensland Premier Annastacia Palaszczuk sent her apologies and was not at the opening as she was attending the Hannah Clarke family funeral. Attorney-General and Minister for Justice Yvette D’Ath, spoke on her behalf.

  • The USC Moreton Bay foundation building on Moreton Parade, Petrie, spans 16,000 square metres over three storeys.
  • It was designed by Hassell Studio and built by construction firm Hansen Yuncken over 18 months on Moreton Bay Regional Council land at Petrie, and was funded through a Commonwealth Government loan of $121 million.
  • The building has a huge central atrium that will be suitable for community events, and has been designed to cater for rapid growth of the student population (up to 3,600 students) over the campus’s first three years.
  • There is a 460-seat lecture theatre, state-of-the-art learning technology, nursing simulation labs, engineering labs, a ‘makerspace’ and library facilities.
  • USC Moreton Bay offers almost 50 undergraduate degrees including Business, Education, Health, Computer Science and Mechatronic Engineering.
  • More than 1,200 students have enrolled to study at USC Moreton Bay this semester, with the most sought-after degrees so far being Nursing Science, Animal Ecology, Psychology, Biomedical Science and Social Work.
  • The campus is tipped to grow significantly over the next decade, with an anticipated student population of 10,000 by 2030.
  • It will become the centrepiece of Moreton Bay Regional Council’s ‘The Mill at Moreton Bay’ development, which was declared a Priority Development Area by the State Government in 2016. This development will include commercial and residential areas, as well as large areas that will be returned to nature.

Bushfire Recovery – Wildlife Carer Grants Now Available

In response to the drought and bushfires, the Queensland Government is helping widlife hospitals and volunteer wildlife carers by committing $250,000, in addition to $6 million already earmarked, to wildlife hospitals and groups, including more than 770 community-based volunteer wildlife carers and care groups.

“Our local wildlife carers and groups have always done a remarkable and selfless job in caring for our local wildlife when they have been injured, and I have always been in awe of their dedication,” said Chris Whiting MP.

“Now with 67.4% of Queensland still drought declared and 2.5 million hectares impacted by the recent bushfires, they have been working harder than ever.

“With more funding available, I want our local carers in Bancroft to get the help they deserve,” said Chris Whiting.

Wildlife hospitals on the frontline of treating injured and sick wildlife, including RSPCA Wildlife Hospital, Currumbin Wildlife Hospital and Australia Zoo Wildlife Hospital, will share $120,000 and the remaining $130,000, will be allocated to eligible individual carers and care groups, to support the operating expenses related to the care and rehabilitation of sick or injured wildlife, including medicines, veterinary supplies and food for animals in care.

Eligible individual carers who do this selfless work on behalf of all Queenslanders can apply for a grant of up to $2,000 and eligible care groups can apply for a grant of up to $5,000.

The round opened on 29 January 2020 with grants provided on an ongoing basis until all funding is allocated. Carers who are interested in applying can register their interest via csagrants@des.qld.gov.au

$76 Million Dollar Bushfire Recovery Package

The Morrison Government has announced a $76 million Tourism Recovery Package to support fire-affected regions and the broader Australian tourism industry and is encouraging locals and international visitors to go on a holiday to support the regions doing it tough.

With Prime Minister Scott Morrison saying Australian tourism is facing “its biggest challenge in living memory”, it is clear that the road to recovery will not be swift, that government action is required and that it is not just the tourism sector that will suffer.

According to ‘Tourism 2020’, which is a whole of government and industry initiative to build resilience and competitiveness in Australia’s tourism, the tourism industry is one of five super growth industries driving the future prosperity of Australia.

With foreign countries issuing warnings about travelling to Australia, there is no doubt that tourism businesses in fire affected regions will be severely impacted by cancellations and collapsing booking numbers, however the flow on effect is something yet to be seen and entire communities will be impacted over the coming months.

Amid the bushfire devastation, Tourism Australia has paused its’ multi-million dollar, overseas television campaign featuring Kylie Minogue.

Under the $76 million dollar package, $20 million has been allocated to a domestic marketing campaign which will swiftly get underway to get locals moving and $25 million is allocated to an international campaign to reignite the foreign visitor market.

Tourism Minister Simon Birmingham has said, “My message to anyone thinking about a holiday, from here or overseas, is that Australia’s towns and our incredible parks and beaches are open for business and they need your help”.

Drought & Fire Forum Held In North Lakes

Federal Member for Petrie, Luke Howarth held a Community Drought and Fire Forum on Wednesday 15th January at The North Lakes Library (The Corso) in response to the ongoing environmental disaster.

He invited Federal Minister David Littleproud and state Opposition Leader Deb Frecklington, to speak with locals on the current situation and outline measures being taken by the Federal Government under the biggest federal response to a disaster since cyclone Tracey.

The forum was attended by more than one hundred locals, who also had the opportunity to ask questions of the MP’s.

There was a broad audience turnout from all corners of the electorate, with representation from various groups including ADF Veterans, Mango Hill Progress Association, Bald Hills Bushies, Redcliffe Environmental Forum, North Lakes Lions and students from The Lakes College and Dakabin State High School.

Mr Howarth thanked the local community for the offers of help his office had received in response to the ongoing bushfire crisis and made particular mention of the individuals and groups he was aware of who had rallied to raise donations. In a statement, Mr Howarth said he was very happy with the turnout and the level of engagement displayed during the forum.

“When I’m out and about in the electorate, locals will often ask me about the drought and bushfire situation, they want to know what the government is doing about it and how they can help.”

“It’s clear that a lot of locals are interested in finding out more about the Morrison Government’s response to these issues, so I made it a priority to speak to the Minister for Water Resources, Drought, Rural Finance, Natural Disaster and Emergency Management and organise for him to visit Petrie and speak to locals.”

Many of the questions during the Q&A centred around climate change and predictably, there were a range of polarised viewpoints. Some in the audience mocked the government at their perceived denial on the issue, others questioned whether the government is doing enough to address climate change and some wanted to make their point that climate change is not man made.

Both Mr Howarth and Mr Littleproud responded well to questions on climate change, reiterating that the Morrison Government both believes that climate change is real, is taking real action and is driving investment in clean energy technologies, via a $3.5 billion Climate Solutions Package, which will enable them to meet the Paris 2030 target.”

Mr Howarth made mention of the Japan Kyoto Protocol 2020 targets, which despite many saying at the time the targets were established, back in the John Howard era, that these targets would never be met, the Kyoto targets have not only been met, but exceeded.

Minister Littleproud, also the MP for Maranoa, hails from the region and encouraged those who wish to contribute in some way to the communities impacted by drought and fire, to visit those communities and spend some money. Opposition Leader and Minister for Nanango, Deb Frecklington also encouraged locals to visit the South Burnett region, spend some money and show support for communities doing it tough.
